1️⃣ What legal weapons for self-defense?
For self-defense we can use a wide range of devices and tools available without permits. It should be remembered that defense against unlawful assault (attack) is a right guaranteed by the 1997 Penal Code in force in Poland. Article 25 § 1. 3️⃣ Is the use of pepper spray punishable?
Pepper gas is a legal means of self-defense, which according to the Law on Arms and Ammunition does not require a permit. The use of pepper gas as a necessary defense is therefore permitted. We can use pepper gas as a self-defense tool against both humans and aggressive animals. However, it is worth remembering that the unwarranted use of pepper gas may result in legal consequences. The use of gas is permitted only for necessary defense.
4️⃣ When can self-defense be used?
The right to self-defense is one of the basic human rights. The legal act that defines necessary defense is Article 25 of the Criminal Code, which states that "He does not commit a crime who, in necessary defense, repels a direct, unlawful attack on any good protected by law." In order for the prerequisites of necessary defense to be met, the requirement is that the attack must be direct - it must threaten some good, and that it must be a real and immediate danger, and not planned in the future. The person repelling the attack has the right to defend himself in such a way as to gain an advantage over the attacker. However, it is worth remembering that the necessary defense must be commensurate with the attack. Therefore, for self-defense it is advisable to use primarily legal means, e.g., pepper spray throwers, stun guns and rubber bullet weapons.
5️⃣ Can a sporting weapon be used for self-defense?
During necessary defense, we have the right to use any means of self-defense that will give us an advantage over the aggressor and is at hand. Theoretically, therefore, in a situation of unlawful, direct and actual attack, a sporting firearm can be used for necessary defense. However, we must remember that we may be liable in court for using a firearm for self-defense, especially if the attacker is injured or fatally shot.
